The owner was seeking coverage from its property insurer for water-related damage to the structural elements of the owner’s steel and concrete building. Harper│Hayes PLLC lawyers successfully argued the client’s “all-risk” insurance policy didn’t exclude, and therefore covered, damage from “repeated or continuous seepage or leakage of water” and “weather conditions,” even though the damage had arguably resulted from faulty construction. The case was also significant because it confirmed that property owners can assert claims under “old” insurance policies (though the damage wasn’t discovered until 2016, the insurer paid for it under a policy from 2005).
