A company specializing in installation of industrial flooring was required to reinstall a clean-room floor in a manufacturing facility three times due to faulty materials from a supplier. The general contractor made a claim for reimbursement of its expenses covering the first two reinstallations. The subcontractor’s general liability insurer agreed to investigate but was not resolving the claim. Harper Hayes attorneys succeeded in convincing the insurer to pay the entirety of the general contractor’s claim on the subcontractor’s behalf. Harper Hayes then secured payment from the builders risk insurer for the subcontractor’s out-of-pocket expenses caused by the third reinstallation.
